1. General Statement
This Risk Disclosure ("Disclosure") is provided by Trustmepay Global Corp. ("Trustpay," "we," "us," or "our"), registered in British Columbia, Canada (BC1540261), at 970 Burrard St. Vancouver, BC Unit 112, V6Z 1V3. This Disclosure is intended to inform you of the material risks associated with trading, holding, and transacting in digital assets on the Trustpay platform at trust-pay.ca.
Trading digital assets involves a high degree of risk and may not be suitable for all investors. Before deciding to trade digital assets, you should carefully consider your investment objectives, experience level, and risk tolerance. You should not invest money that you cannot afford to lose.
2. Market Volatility
Digital assets, including BTC, ETH, SOL, and USDC, are subject to significant price volatility. Prices can fluctuate dramatically within short periods, and you may experience substantial gains or losses. The value of your digital assets may decline to zero. Past performance of any digital asset is not indicative of future results.
While stablecoins such as USDC are designed to maintain a stable value relative to the U.S. dollar, there is no guarantee that they will maintain their peg at all times. De-pegging events, reserve insolvency, or regulatory actions may cause stablecoins to lose value.
3. Liquidity Risk
Digital asset markets may experience periods of reduced liquidity, during which it may be difficult or impossible to buy or sell assets at desired prices. Low liquidity can lead to increased slippage, wider bid-ask spreads, and delayed execution of orders. In extreme market conditions, trading may be temporarily suspended.
4. Technology Risk
Digital assets and blockchain networks are based on complex and evolving technologies. Risks include:
- Software vulnerabilities: Smart contracts and blockchain protocols may contain bugs or exploits that could result in the loss or theft of funds.
- Network failures: Blockchain networks may experience congestion, forks, or outages that could affect the processing of transactions or the value of assets.
- Platform downtime: While we strive for high availability, the Trustpay platform may experience downtime due to maintenance, technical issues, or cyberattacks.
- Irreversibility of transactions: Digital asset transactions are generally irreversible once confirmed on the blockchain. Sending assets to an incorrect address will likely result in permanent loss.
5. Cybersecurity Risk
Digital asset platforms and individual users are targets for cyberattacks, including phishing, hacking, social engineering, and malware. Despite our implementation of industry-standard security measures (encryption, multi-factor authentication, cold storage, and regular security audits), no system is completely immune to attack. There is a risk that unauthorized third parties may gain access to your account or the Platform, potentially resulting in the loss of your funds.
You are responsible for securing your account credentials, enabling two-factor authentication, and using secure devices and networks when accessing the Platform.
6. Regulatory Risk
The regulatory landscape for digital assets is rapidly evolving in Canada and internationally. Changes in laws, regulations, or government policies may adversely affect the value of digital assets, restrict trading activities, or require Trustpay to modify or discontinue certain services. Regulatory actions could include:
- Prohibition or restriction of digital asset trading in certain jurisdictions
- Imposition of new licensing or compliance requirements
- Changes in tax treatment of digital assets
- Enforcement actions against digital asset issuers or platforms
- Restrictions on the use of stablecoins or specific digital assets
7. No Insurance or Deposit Protection
Digital assets held on the Trustpay platform are not insured by the Canada Deposit Insurance Corporation (CDIC) or any other government deposit insurance program. Unlike bank deposits, digital assets held with Trustpay are not guaranteed, and in the event of insolvency or other financial failure of Trustpay, you may lose some or all of your digital assets.
8. Counterparty Risk
When you trade digital assets on the Platform, you are exposed to counterparty risk. There is a possibility that the other party to a transaction may default on their obligations. While Trustpay acts as an intermediary to facilitate trades, we do not guarantee the performance of any counterparty.
9. Tax Implications
Trading digital assets may result in taxable events, including capital gains or losses. Tax laws regarding digital assets vary by jurisdiction and are subject to change. Trustpay does not provide tax advice. You are solely responsible for understanding and meeting your tax obligations. We recommend consulting with a qualified tax professional.
10. Third-Party Risk
The Platform relies on third-party service providers for essential functions, including payment processing and identity verification. Failures or disruptions at third-party service providers may affect the availability, security, or functionality of the Platform. Trustpay is not responsible for losses resulting from the actions or omissions of third-party service providers.
11. Risk of Loss
You acknowledge and agree that:
- You may lose some or all of the digital assets you trade or hold on the Platform.
- You bear sole responsibility for any losses incurred as a result of your trading decisions.
- Trustpay does not guarantee profits or protection against losses.
- You should only trade with funds you can afford to lose entirely.
12. No Investment Advice
Trustpay does not provide investment, financial, legal, or tax advice. Any information provided on the Platform, including market data, charts, or educational content, is for informational purposes only and should not be construed as a recommendation to buy, sell, or hold any digital asset. You should conduct your own research and seek independent professional advice before making any investment decision.
13. Acknowledgement
By using the Trustpay platform, you acknowledge that you have read, understood, and accepted the risks described in this Disclosure. You confirm that you are willing to assume these risks and that Trustpay shall not be held liable for any losses arising from the risks described herein.
